Terms of use
These Terms and Conditions govern all sales and prevail over any other stipulations proposed by the Buyer. Any order placed by the Buyer implies full adherence, without restriction or reservation, to these Terms and Conditions.
1. Orders
Orders placed through the website bind the Buyer as soon as the Buyer gives acceptance of the order on the website. Product information, photographs, and graphics in catalogs are for reference only and do not bind the Seller. Once the Buyer has submitted an order, they are deemed to have accepted the prices, volumes, and quantities offered for sale without reservation.
2. Price
The sale prices of products are those in effect at the time the order is recorded, excluding shipping fees. Product prices may be modified at any time due to external events. Shipping fees are borne by the Buyer and charged in addition to the product prices, based on the order amount. Shipping fees will be indicated when the Buyer places the order.
3. Payment
Unless otherwise agreed, products are payable upon order. Any sum paid by the Buyer before delivery constitutes a deposit on the price due. Penalties equal to the bank base rate plus three points shall automatically apply to unpaid amounts exceeding ten (10) days after the invoice date or upon notification of payment rejection for any other payment method. Delivery of any new order may be suspended in case of late payment of a previous order.
4. Delivery
Delivery times vary by destination. For metropolitan France: delivery within ten (10) business days from payment receipt; for other destinations: delivery within twenty-five (25) business days from payment receipt. Delivery is deemed completed upon making the product available to the Buyer. The Buyer must verify shipments upon receipt and file any justified claims. If delivered products do not conform in nature or quality to the specifications indicated on the delivery note, the Buyer must submit claims within eight (8) days after delivery.
5. "Satisfied or Refunded"
The Buyer has seven (7) clear days from delivery to return the product, at the Buyer’s expense. The Buyer will be refunded the product price within one (1) month of receipt of the returned item by Top Bagage International. Products returned incomplete, damaged, or soiled will not be accepted.
6. Out-of-Stock
In the event of an out-of-stock situation on an online product, the Company commits to inform the Buyer of the stock status and restocking delay. The Buyer may choose to maintain or cancel their order. In case of cancellation, the Company will refund the Buyer within eight (8) business days.
7. Retention of Title
The Seller retains full ownership of sold products until full payment of the price, including all fees and taxes. Risk transfer occurs upon handing over the product to the carrier. The Buyer is responsible for insuring the goods against all risks (e.g., damage, loss).
8. Warranties
Products sold benefit from the manufacturer’s warranty. Excluded from this warranty are all products modified or repaired by the Buyer or any other person not expressly authorized by the Seller, as well as products covered by a specific maintenance contract. Any return of a product under warranty must receive prior agreement from the Seller. To this end, the Buyer shall contact the Seller’s after-sales service by email. If the product is recognized as defective, the Seller will provide a return authorization number. The defective product must be returned in its original packaging with the provided return authorization number. All costs and risks related to the return are the Buyer’s responsibility.
9. Jurisdiction
These Terms and Conditions are governed by French law. For any disputes relating to this contract between the Seller and the Buyer, the Commercial Court of Rennes shall have exclusive jurisdiction.
10. Data Protection
In accordance with the French Data Protection Act of January 6, 1978, the Buyer has the right to access and rectify personal data concerning them and held by the Seller.
